TERMS AND CONDITIONS OF SERVICE

Royal Bus Guatemala

1. Identification of the service provider

Royal Bus Guatemala (hereinafter, "Royal Bus") provides private ground transportation services for passengers, operating in Guatemala and other countries in the region, in accordance with current laws and regulations.

2. Service Description

Royal Bus offers private transportation services that include, unless expressly agreed otherwise:

  • Transport unit assigned according to quotation
  • Professional pilot
  • Driver with full per diem allowance included
  • Fuel costs
  • Parking
  • Passengers insurance

Any additional service not expressly included in the quote (overtime, detours, additional days, special tolls, etc.) will be considered an additional charge.

3. Reservations and payment conditions

3.1 Reservation

To confirm a reservation, the customer must make a deposit of 50% of the total service value, unless otherwise agreed in writing.

The reservation is not considered confirmed until the corresponding payment has been received and validated by Royal Bus.

3.2 Payment of the balance

The remaining 50% must be paid at the start of the trip, unless a different agreement is made in writing.

3.3 Accepted payment methods

  • Card payment
  • Bank transfer
  • Bank deposit

4. Cancellation and Refund Policy

In case the customer decides to cancel a reservation:

  • With 10 days or more notice: 100% of the deposited amount is refunded, with no penalty.
  • With at least 5 days' notice: 50% of the deposited amount will be refunded.
  • With less than 5 days’ prior notice: no refund applies.

Refunds, when applicable, will be issued using the same payment method or another method determined by Royal Bus.

5. Cancellations due to causes beyond Royal Bus’s control

If a trip or service cannot be completed due to causes beyond Royal Bus’s control, including but not limited to:

  • Lack of required passenger documentation
  • Immigration restrictions
  • Decisions made by authorities
  • Unforeseen events attributable to the client

The service shall be considered fully rendered, and no refund shall apply.

6. Client Responsibility

6.1 Documentation

The client is fully responsible for ensuring that each passenger holds the required documentation, especially for international travel or border crossings.

Royal Bus shall not be liable for delays, cancellations, or penalties resulting from non-compliance with this requirement.

6.2 Proper Use of the Vehicles

The client and their passengers agree to make proper and responsible use of the vehicles.

In the event of severe stains, damage, or excessive soiling of the upholstery, a fixed charge of Q800 shall apply for specialized upholstery cleaning, without prejudice to any additional damages that may be applicable.

7. Time Extensions, Returns, and Additional Expenses

If the service extends beyond the agreed schedules, or if additional expenses are incurred due to causes attributable to the client, the client shall be required to cover the additional amount, which will be informed and agreed upon at the time.

8. Mechanical Failures

In the event of an unexpected mechanical failure, Royal Bus commits to responding as promptly as possible to complete the service, whether through repair, vehicle replacement, or another viable solution.

No penalty shall apply unless a Service Level Agreement (SLA) has been previously agreed upon in writing.

9. Forgotten Items

Royal Bus shall not be held responsible for any items left inside the vehicles once the service has been completed.

Vehicles are inspected on the day following each trip.

In the event that forgotten items are found:

  • The client shall be responsible for covering all shipping costs.
  • Items will be sent via express courier, Forza, Uber, or another method as agreed.

10. Invoicing, Late Payment, and Service Suspension

Unless otherwise agreed, invoices must be paid within a maximum period of 21 business days.

In the event of late payment:

  • Royal Bus may apply a fixed interest charge of 10% on the outstanding balance.
  • Royal Bus reserves the right to suspend services without prior notice.

If payment remains outstanding for more than 60 days, Royal Bus may engage collection services, and all legal and collection costs shall be borne by the client.

11. Taxes and Withholdings

Any withholding at source or applicable tax in accordance with the client’s country’s legislation shall be the sole responsibility of the client.

The invoiced amount must be paid to Royal Bus in full.

12. Limitation of Liability

Royal Bus commits to providing the service with the highest level of diligence possible, without this constituting an obligation of results.

Royal Bus may not be required to act as a third party in claims brought by end consumers against the client.

13. Claims

Any claim must be submitted in writing to Royal Bus within a maximum period of 8 days following the provision of the service.

14. Amendments

Any exception to or modification of these Terms and Conditions must be expressly agreed upon in writing.

15. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Guatemala.

Any dispute arising herefrom shall be submitted to the competent courts of Guatemala.
